Court frames charges against JE in DA case

JAMMU, June 8: Additional Sessions Judge Anti Corruption, Rajouri Mehmood Chowdhary has framed charge against Romesh Chander S/O Late Patti Ram R/O W. No.5 Jawahar Nagar Rajouri, the then J.E PWD Sub-division Sunderbani Rajouri. The allegation in the charge sheet are that a secret verification conducted in pursuant to a complaint lodged against Romesh Chander wherein it surfaced that suspect has acquired huge assets both movable as well as immovable disproportionate to his non source of income by resorting corrupt and illegal practice by abuse and misuse of his official position. Accordingly FIR N.40/2018 in Offence U/S 5(1)(e) r/w 5(2) of J&K Prevention of Corruption Act registered and investigation commenced.
On the conclusion of investigation it was established that accused has raised.1. Three storey house fully furnished house with modern facilities and costly electronic gadgets at Jawhar Nagar Rajouri, 2-One commercial plot at Jawahar Rajouri. 3-Land and building at Dhangri, 4- Four Shops constructed on a piece of land at village Dhangri, 5-Land measuring 4 Kanals at Dhangri, 6- Two Tippers Nos. JK11-7736 and JK11-7526, 7- one Luxury car Verna.
It has been emerged that accused by taking advantage of his official position is owning a Brick Kiln at Dhangri besides invested proceeds of his ill gotten money in Vikrant finance company Rajouri. The accumulation of property/assets has been raised by the suspect officer either in his own name or in the name of his family members which amounts to criminal misconduct U/S 5(1)(e) r/w 5(2) of J&K Prevention of Corruption Act 2006. After hearing both the sides the court observed that the existence of prima-facie evidence proving grounds for presuming that accused has committed the offence as alleged and the material available on record prima-facie established involvement of the accused in the commission of offence. Accordingly the court framed the charge. —JNF
