| Directs company to pay Rs.2, 09, 061 to complainant with interest | | Consumer Forum castigate ICICI Lombard | | EARLY TIMES REPORT Jammu, Jan19- Taking serious notice of the gross negligence and highest degree of deficiency in service and unfair trade practice on the part of the insurer vis-à-vis insured, The Divisional Consumer Forum headed by S L Pandita today directed the ICICI Lombard GIC to make payment of Rs.2.09, 061 along with interest @ 6 % PA to the complainant. This directive was passed on a complaint filed by Ashok Kumar Hakhoo, a state Government employee who was covered by mediclaim insurance Scheme for which the Government of J&K had tied-up with ICICI Lombard Health Insurance Family Health Plan Ltd for the year 2005-2006. According to the complainant that during policy period he suffered heart ailment and cardiologist after examination advised him to go for surgery. The complainant was required to undergo immediate surgery as per the advice of the doctor and was also advised to get admitted in the hospital and submitted a claim of Rs 2, 26, 161. The Insurance Company issued two cheques paid only Rs 17,100 and refused payment of Rs 2, 09, 061. SL Pandita President of the Forum after hearing both the sides observed that the present case reflects gross negligence and highest degree of deficiency in service by the concerned Insurance Company and allowed the petition with the directions to the company to make payment of over two lakhs to the complainant along with litigation charges.
