Alleged rapist of a minor girl rejected bail

Jammu, Jan 20- Rejecting the bail application of one Ramesh alias Nika allegedly involved in a rape case of a minor girl, Chief Judicial Magistrate Jammu, YP Bourney observed that in the light of the allegation against the applicant, Court is not a position to accept the contention of the applicant that there is nothing on record to connect the accused with the commission of alleged offence. The court further observed that the circumstances unfolded so far clearly point out that the accused acted as conduit and facilitated the perpetration of heinous offences on a girl who is under 15 years of age. The investigation is still at progress and the relations of the other girl with the accused/applicant are yet to be ascertained. The role played by the other girl is yet to be ascertained but the very fact that she is missing after the occurrence, it appears that she too was a party to the nefarious designs of accused and it appear to be an pre-planned crime perpetrated by the applicant and others on the victim. In the process they have ruined the life of a minor girl, thus accusations are well founded and the gravity of the offences and the manner in which same have been committed shakes the conscience of the every responsible citizen. The applicant does not deserve to be given the liberty of bail and rejected the bail application.
According to the police report on December 14, 2008 the police post Rehari forwarded the report to Incharge Police Station Bagh-e-Bahu under whose jurisdiction occurrence had taken place. According to FIR u/s 376, 342/34 RPC that on December 10, 2008 evening prosecutrix was persuaded by another girl for accompanying her to Bagh-e-Bahu after pay obeisance at the temple and for taking tea at a teal stall when two young boys who were known to other girl appeared and persuaded them to accompany them to their place for stay at night. Both the boys had prepared meat and took liquor and then allegedly raped forcibly with the prosecutrix. The other girl since then is reported missing for which a missing report was registered at Police Post Rehari on December 12, 2008.
