| HC dismisses ETT College’s plea for allocation of students | | | Early Times Report Jammu, Jan 22 - Vacation Judge of J&K High Court, Jammu Wing Justice Hakim Imtiyaz Hussain today dismissed the CMP filed by Shiksha Niketan and RM Elementary Teachers Training Colleges seeking direction to J&K Board of School Education to allocate students for the current session. While deciding the CMP, Justice Hussain after hearing both the sides, observed that Court perused the order January 15, 2009 passed by the respondents that in order to maintain strict academic standards in regard to the ETT courses, an institute must run an academic course for a minimum of 180 days in an academic year and the candidates must put in 75% attendance in one academic session. The respondents stated that the class work has already taken with effect from November 18, 2008 and keeping in mind the holidays, Sundays and other Gazatted holidays during this period, the Board has decided to hold the examination for the students after June 20, 2009. In case the process of counseling was to be started afresh, it would consume a lot of time. Any admission made at this belated stage would not make it impossible for a candidate to undergo the minimum 180 days course, nor would the candidate be in a position to secure 75% attendance. Justice Hussain after considering the matter further observed that the stand taken by respondents cannot be ignored merely on the contentions of the petitioners. The classes have already started from November 18, 2008. The candidates if granted admission at this stage cannot cover the syllabus in the current academic year nor can such candidates are in a position to secure attendance as required under the rules. With these observations Court dismissed CMP filed by the petitioner's colleges. JNF
