Rape accused denied bail

Jammu, Jan 23- Rejecting the bail application of Parham Badage, a resident of Orrisa,
involved in an attempt to rape of a teenaged girl, Principal Sessions Judge Jammu, S.S
Sarangal observed that offence has been committed on a minor, which is against the society and particularly against children. Prosecution has produced some of the witnesses while some of witnesses are yet to be examined by the prosecution. The punishment for offence u/s 376 RPC which has allegedly been committed by the accused is imprisonment for life or 10 years and fine also. Above all the offence has been allegedly committed upon the minor-female child of four years and in such a heinous offence, he does not deserve bail at this stage and in case he is granted bail, wrong signal will go to the public.
Public Prosecutor EA Tak, appearing for the state, pointed out that the accused is a resident of Orissa State, and in case he is bailed out, there is every likelihood the he will jump over the bail.
Court further observed that keeping in view of the facts and circumstances of the case, the accused has been involved in an offence u/s 376/511 RPC which is a heinous in nature and accused cannot be released on bail at this stage. The victim is a female child and she needs sympathy from the society and not this type of harsh act. The act of the accused is against the society in general and particularly against women folk. As such accused does not deserve bail at this stage and the same is rejected.
It is worthwhile to mention here the offence was committed on September 9, 2006 and a case was registered by the police u/s 376/511 RPC and accused was in custody since long.
Prabhat Badade a resident of Orissa and was working a labourer at that time had committed the offence of attempt to rape on a minor girl of four years.
