| SC drops Bhim’s RS poll petition | | | Early Times Report
Jammu, Jan 23: The Supreme Court of India has refused to entertain Panthers Party leader Bhim Singh’s much talked about petition challenging Election Commission’s separate notification for four Rajya Sabha seats from Jammu and Kashmir due for elections on February 13. A writ petition under Article 32 of the Constitution of India filed by Panthers Party leader Bhim Singh in the Supreme Court of India was not entertained by a Division Bench of the Supreme Court headed by Chief Justice, Mr. K.G. Balakrishnan today. The Supreme Court said that judiciary cannot interfere in the electoral process while the process has begun. Chief Justice made this observation on the petition of the Panthers Party Chief who vehemently argued that holding election to four Rajya Sabha seats on the same date, through the same Electoral College for maximum tenure of six years by the same authority through three separate notifications is meant to benefit the ruling alliance in J&K. He said that this Election Commission of India is arbitrary, discriminatory and biased in favour of Congress and National Conference. The Chief Justice observed that the election process started when Election Commission announced the schedule of the election and therefore court cannot issue mandamus. Prof. Bhim Singh told the Chief Justice that such an action of the Election Commission is betrayal of justice and rule of law.
