| PSC notification for Lecturers in Bio-Chemistry post stayed | | | Early Times Report Jammu, Jan 24- Vacation Judge of J&K High Court Jammu Wing Justice Hakim Imtiyaz Hussain, in a petition filed by Dr. Rachna Sabharwal challenging the Advertisement notification dated December 31, 2008 for the post of lecturers in Bio-Chemistry in the GMC Jammu, issued notice to the respondents and stayed the impugned notification so far it relates to the post of Bio-Chemistry till objections are filed. The petitioners challenged the notification on the ground that the post of lecturer in Bio-Chemistry in the department of Bio-Chemistry GMC Jammu is governed by the rules J&K Medical Education (Gazetted) Service Recruitment Rules 1979 as amended up-to-date. The qualification for the cadre post in said recruitment rules have been provided in scheduled-II. For the post of lecturer in Bio-chemistry the source of recruitment is from two sources, from the medical persons and from non-medical persons. So far as medical persons are concerned, the qualification provided by rules is PG Degree in Bio-Chemistry, MD, PhD and DSC whereas the qualification required for non-medical person is PhD in Bio-Chemistry. It is further submitted that the regulations provided that 30% of the posts in the department of biochemistry will be filled up from non-medical candidates. The same is provided by the general note forming part of recruitment rules. As per the position of rules, the non-medical teachers can be appointed to the extent of 30% of the total posts except for head of department.. In the prayer petitioners sought quashment of the advertisement notification No 13-PSC of 2008 dated December 31, 2008 in so far it related to the posts of lecturers in Bio-chemistry in GMC Jammu. Petitioner are also seeking further direction to the respondents to re-advertise the post of lecturers in Bio-Chemistry strictly as per the rules, guidelines issued by the Medical Council of India.
