Court rejects bail of accused in bovine transportation case

Reasi, July 27:Chief Judicial Magistrate Reasi, Archana Charak has rejected the bail application of accused involved in transportation of bovine animals on a fake and frivolous permission in Reasi District of Jammu and Kashmir. On the grounds taken in the instant application are that police arrested the applicants in false and frivolous case on the false instigation and false story. Applicants have neither committed any offence nor involved in the commission of any such offence. Content of the FIR are very dramatic, unfair, unreasonable and untrue.They undertake to abide by all the terms and conditions imposed by Court while granting bail to them. On this Ld. APP raised the objections in the process of bail on the count that investigation of the case is at its infancy and get adversely affected if the applicants are admitted to bail at this premature stage. Scanning of Police report, objections and CD file reveals that accused persons namely Arshad Hussain and Mohd Aslam impersonated themselves as Fateh Mohd and Sher Mohd respectively before the Court and got released bovine animals in case FIR No. 42/2023. Further these accused persons produced annual migration persmission by changing photographs pasted on the permission which was contrary to permission document collected by the I.0. from the Office of SDM, Mahore. During inguiry it has also been found that the said persmission was issued in the name of Fateh Mohd S/o Shamas Din R/o Neosi, Chassana along with photocopy of Aadhar Card of a person namely Fateh Mohd but photograph was not clear and after inquiry accused persons disclosed that bovine animals belong to Fagir Mohd S/o Noora R/o Neosi and on whose direction accused persons were transporting these bovine animals. It is pertinent to mention here that the instant F.LR. 44/2023 is off-shoot of F.I.R. No. 42/2023 & 43/2023 u/s 188 IPC & 11 PCA - 6. Act Accused persons want to run bovine business for monetary benefits without getting their names involved in police files. In whole Ld APP submitted for the rejection of bail.
