| HC directs respondents to accept petitioners’ forms for PO post | | | Early Times Report Jammu, Jan 26- Vacation Judge of J&K High Court Jammu Wing Justice Hakim Imtiyaz Hussain in a petition challenging the criteria of qualification of LL.B Degree for filing up the post of Public Prosecutor has directed the respondents to accept the forms of petitioners. This direction has been passed in a petition filed by Hitesh Kumar Choudhary and others who have applied for the post of Prosecuting Officer advertised by the respondents on January 3, 2009 under which the qualification has been prescribed as LL.B from a recognized university. Petitioners have obtained LL.B Degree in the year 2008. The grievances of the petitioners are that respondents are not accepting their forms on the ground that only those candidates are eligible who have obtained the LL.B Degree in the year 2007, Adv Vishal Sharma appearing for the petitioners submitted that the condition put by the respondents is illegal, arbitrary and in violation of the provisions of the Constitution. Vacation Judge, after going through the advertisement notice dated January 3, 2009 and also the advertisement notice dated October 25, 2007, observed that no such condition is put neither of advertisements notices and issued notice to respondent State of J&K through DGP and DIG of Police Jammu-Kathua Range. In the meanwhile, Court directed that respondents shall accept the forms of the petitioners and allow them to compete in the examination. However, result of the petitioners shall not be declared till final outcome of the CMP. JNF
