| CB to investigate cheating case against Sainik Coop Housing Society | | | Early Times Report Jammu, Jan 26- On a complaint filed by JC Abrol, father of a serving captain, seeking direction to the Crime Branch to register FIR against the Chairman and others of the Sainik Cooperative Housing Society for cheating the complainant, Chief Judicial Magistrate YP Bourney has directed SSP Crime Branch Jammu to proceed with the applicant and investigate the matter and register the case if made out. The complainant has sought registration of FIR against the accused namely Amar Singh then chairman, Jagdev Singh Jamwal, Legal Advisor, Col Sukhdev Singh Member of Board, Cashier Puran Chand and Architect Sainik Cooperative House Building Society Jammu u/s 420, 406, 468/34 RPC. In the complaint it has been submitted that the son of the applicant serving as captain in army and posted in some other state wanted to buy a plot of land in Jammu. He came to know about Sainik Cooperative House Building Society Jammu and requested his father to get all the information regarding the society. The applicant collected all the information and brought the form after payment of Rs 100 on October 23, 1996. The applicant's son paid Rs 20000 on November 1996 and then paid an amount of Rs 2650 on March 26, 1997 for different charges. Then again on March 26, 1997, applicant's son paid Rs 47500. All the money was paid to Amar Singh then Chairman of the society in the presence of other accused persons. Applicant also gave a sum of Rs 50000 as he wanted to give him half of amount of total money to buy the land. In the complaint it has been further alleged that accused persons gave assurance to the applicant that possession of residential plot in Sec-E Phase-II measuring half a Kanal at Sainik Colony village Sunjwan Choadi Tehsil Jammu would be given after the required amount was deposited and all the conditions were fulfilled by the son of complainant. The lease deed was executed and duly registered before the Sub-Registrar Udhampur on January 3, 1998. After the registration of lease deed, the applicant approached the accused persons time and again but possession of land was not given to him. In the complaint it has been alleged that the accused persons have cheated the applicant and his son forging the site map. The applicant is trying to get possession of land for the last more than 10 years but accused persons are only giving fake assurances and false promises. The applicant wanted to lodge FIR against accused persons in Crime Branch but police officers present their refused to lodge FIR against accused persons and prayed before the Court that SSP Crime Branch may kindly be directed to lodge FIR and investigate the case.
