High Court upholds detention of terrorism supporter under PSA

Jammu, Aug 9: Justice MA Chowdhary of the Jammu & Kashmir and Ladakh High Court has upheld the detention of Abdul Hameed Ganie, also known as Dr. Hameed Fayaz, under the Public Safety Act (PSA). Ganie is identified as a hardcore motivator and supporter of terrorists, actively working towards the secession of Jammu & Kashmir from the Union of India with the intent of merging it with Pakistan.
The court’s decision came after considering Ganie’s history of promoting hatred and disaffection against the army, notably in the town of Shopian in 2009. Furthermore, an FIR was previously registered against him under Sections 10, 11, and 13 of the Unlawful Activities Prevention Act at Police Station Budgam.
Justice MA Chowdhary, after evaluating the arguments from both sides, dismissed the petition against the detention. The court emphasized that a detention order is primarily a preventive measure, designed to shield society from anti-social and subversive elements that could endanger the nation’s welfare, security, public tranquility, and engage in unlawful activities.
Preventive detention, the court noted, is not intended to punish individuals for their actions but to intervene and prevent potential harm to society. The ruling aligns with consistent jurisprudence on the subject, highlighting the importance of preserving societal safety through such measures.
