| Capt Mega Razdan suicide | | HC issues notice to Government | | Early Times Report
Jammu, Jan 28- In a much publicized suicide case of Capt. Mega Razdan, Vacation Judge of Jammu and Kashmir High Court Jammu Wing, Justice Hakim Imtiyaz Hussain today issued notice to the State of Jammu and Kashmir through Principal Secretary Home and SHO Police Station Angela Jammu and directed the Registry to list the case after the service is complete.
This direction was passed in a petition filed by Captain Chaitnaya, who is facing trial in suicide case of his wife Capt Mega Razdan.
After hearing Senior Advocate Sunil Sethi, the Vacation Judge dictated the order in the open Court, issued notice to State of J&K through Principal Secretary Home and SHO Police Station Gangyal Jammu and directed Registry to list the case after service is complete.
In the petition the petitioner seeking quashment of FIR NO 34/2008 and subsequently challan filed in the Court of 3rd Additional Sessions Judge Jammu on various grounds.
In this much publicized case wife of the petitioner Capt Mega Razdan committed suicide by hanging at her official residence on July 1, 2007. On the report of Commanding Officer, proceedings u/s 173 Cr PC was initiated and statement was recorded by the police. After the conclusion of the proceedings, a formal FIR was registered against Capt Chaitnaya husband of the deceased in view of the prima-facie findings coming against the petitioner being the cause of suicide committed by his wife. After registration of FIR u/s 306/498-A Cr PC on March 29, 2008 petitioner was taken into custody by the police and remained in custody till he was granted bail by the High Court on December 4, 2008.
The petitioner prayed before the Court of setting aside the order of 3rd Additional Sessions Judge Jammu passed on September 24, 2008 in a criminal challan titled State Vs Capt Chaitnaya where by charge has been framed against the petitioner u/s 306/498-A RPC and further prayed to quash the challan and direct discharge of the petitioner from criminal case pending trial against him in the Trial Court.
