67 yr old gets lifer for murdering his daughter in law

Rajouri, Jan 30-Principal Sessions Judge Rajouri Subash Chander Gupta today awarded life-imprisonment to Lochan Ram a 67 years old Ex-Army Personal resident of Lamberi Tehsil Nowshera who committed murder of his daughter-in-law on February 10, 2001.
In his 85- page judgment, Principal Sessions Judge, after hearing both the sides and referring a judgment of Bombay High Court on the issue sentence, observed that from the facts and circumstances of the present case, the murder committed by the accused Lochan Ram is the outcome of the lust for women and by animalism and vengeance. He is considered as menace to the family of the deceased and the society at large. He cannot by any stretch of reasoning be considered as hardened criminal, who lives on and for the crime. On consideration of his age, which could be more than 67 years and other facts and circumstances of the case it can be said that mitigating circumstances have overweighed. He is required to be given chance to repent and reform himself. Heinousness and gravity of offence committed by the accused would be sufficiently avenged by imposing life-imprisonment. Imprisonment for life and fine is a rule and death penalty is an exception. For absence exceptional circumstances and as such, case in hand does not fall within the ambit of rarest of rare for imposing death penalty. With these observations Court awarded imprisonment for life to accused Lochan Ram son of Sant Ram resident of Lamberi Tehsil Nowshera District Rajouri and Rs.5000 as fine.
According to the prosecution case on a report of a Panchayat member Jai Ram on February 10, 2001 police registered a case and during investigation it was alleged that accused had developed illicit relations with his daughter-in-law, the relatives of the accused prevailed on the accused by persuading him not to engage in the said activities. However the accused on the day of occurrence tried to commit rape on his daughter-in-law. But on her refusal he committed the murder of his daughter-in-law. JNF
