Jammu, Feb 03- Dismissing the appeal with costs the, State Consumer Disputes Redressal Commission headed by Justice G D Sharma has directed the National Insurance Company to pay Rs. one lakh as award along with the additional cost of Rs.4000 to the Insurer
Aggrieved by the decision of the Divisional Consumer Forum dated July 16, 2007 directing the National Insurance Company to make payment of Rs one lakh with litigation charges of Rs.2, 000 to the complainant, the Company filed an appeal with the State Commission which was dismissed here today.
The Commission Comprising Justice GD Sharma (Retd) President and BL Saraf its member, after hearing both the sides, upheld the order of Divisional Forum Jammu and dismissed the appeal with the costs of Rs 4000 in addition to cost already awarded by the forum.
The judgment written by Justice Sharma for the Forum observed that Anjana Chadha of Bakshi Nagar Jammu had initially taken the medical insurance policy which was initially valid up to April 6, 2000 and was subsequently renewed for one more year for the period from May 11, 2001 to May 10, 2002. She suffered from a disease and after receiving the treatment from Rajiv Gandhi Cancer Institute approached the Insurance Company for disbursement of expenses to the tune of Rs 1, 16, 894 which she had incurred for her treatment. On the rejection of her claim by the Insurance Company, she filed complaint with Divisional Forum which decided the case in favour of the complainant. JNF
