High Court closes PIL on lack of parks, gardens in J&K

JAMMU, Oct 10: A Division Bench of the Jammu & Kashmir and Ladakh High Court, comprising Chief Justice N. Kotishwar Singh and Justice Moksha Khajuria Kazmi, has closed a Public Interest Litigation (PIL) related to the lack of parks and gardens in Jammu & Kashmir. The Bench expressed satisfaction that the authorities are taking the necessary steps for the maintenance and preservation of green spaces and parks.
The Division Bench stated that it may not be necessary to monitor the situation at this stage and accordingly closed the PIL with the mentioned observations. However, the Bench also emphasized that if the authorities fail to continue maintaining and preserving green spaces and parks, the petitioner has the liberty to reactivate the PIL.
The PIL had raised concerns about the inadequate number of parks and gardens, particularly in the cities of Srinagar and Jammu. Reports submitted by the authorities highlighted various measures taken to maintain and preserve parks and gardens in response to the court's orders. The reports also mentioned significant achievements, such as the Tulip Show 2022, which earned recognition in the World Book of Records (London) for being Asia's largest tulip paradise.
Additionally, the reports noted efforts to conserve and maintain Mughal Gardens like Nishat, Shalimar, Cheshmashahi, and Pari Mahal, which have been tentatively listed as UNESCO World Heritage Sites. A collaborative partnership has been initiated for the conservation and maintenance work at select sites within these gardens.
The reports also highlighted steps taken for the maintenance of parks and gardens in the Jammu Division, including the prohibition of single-use plastic, the installation of grill fencing, the provision of toilet facilities and Mali sheds, the construction of well-constructed pathways, the establishment of compost pits, the construction of ramps for disabled individuals, and the transfer of certain parks to Urban Local Bodies.
While the PIL has been closed, the authorities have been urged to continue their efforts to maintain and preserve green spaces and parks in Jammu & Kashmir to benefit the public and the environment.
