HC directs consideration of Arms, Ammunition dealership pleas | | | Early Times Report JAMMU, Oct 10: Justice Mohd Akram Chowdhary of the Jammu & Kashmir and Ladakh High Court has directed the respondents to consider the pleas raised by the petitioners for the issuance of arms and ammunition dealership licenses. This consideration should be made in accordance with the new rules, specifically Form VIII, provided that the petitioners have completed all the necessary formalities. The respondents have been instructed to review the cases of the petitioners on a 'case to case' basis within a period of four weeks from the date when a certified copy of the judgment is provided to them for compliance. During this period, subject to meeting the required conditions under the new rules, the petitioners will be allowed to continue their businesses. This order comes as a result of a petition filed by the petitioners, who hold licenses as arms and ammunition dealers under the Arms Act, 1959, and Arms Rules, 1962. They collectively raised concerns based on similar facts and grounds, seeking the quashing of Circular No.01-Home of 2023 dated 10.04.2023, which was issued by Respondent No.1. This circular had directed District Magistrates not to allow arms and ammunition dealers to carry out their trades and transactions unless they held valid Arms Licenses in Form VIII, as prescribed under the Arms Rules, 2016. The circular also contained other directions related to this matter. The High Court's directive ensures that the pleas of the petitioners are considered, taking into account the new rules, and provides them with the opportunity to continue their arms and ammunition dealership businesses during the review process. |
