| HC stays withdrawal of 46 posts of teachers’ in Udhampur district | | | Early Times Report Jammu, Feb 06- While staying the operation of communication dated May 9, 2008 relating to the withdrawal of 46 posts out of 336 posts of teachers in District Udhampur Justice Sunil Hali of J&K High Court Jammu Wing today issued notice to State of Jammu and Kashmir through Commissioner-Secretary Education Department, Chairman and Secretary SSRB and others returnable within three weeks. This significant direction has been passed in a petition filed by Subash Chander and others in which Senior Advocate AV Gupta assisted by Adv YE Tak appeared for the petitioners. The petitioners challenged the communication dated May 9, 2008 addressed to Secretary J&K Service Selection Board in which under secretary to Government Education Department was requested to withdraw 46 posts out of 336 posts of teachers of District Udhampur. During the course of arguments Senior Advocate AV Gupta submitted that the petitioners, who are highly qualified, have applied for the posts of teachers in District Cadre Udhampur pursuant to advertisement notice dated April 22, 2008 and the petitioners faired well in the interview. The total number of posts of teachers under the said advertisement notice was 336. However, respondents made selection for only 290 posts and remaining 46 posts were kept unfilled. The petitioners approached the respondents for knowing the reasons for not filling-up 46 posts but no body was ready to give audience or explanation to the petitioners as to why 46 posts have not been filled-up as per advertisement notice. Justice Hali, after hearing the counsels for the petitioners issued notice to state of J&K through commissioner/secretary Education Dept, Chairman and Secretary SSRB and others returnable within three weeks and observed that it is averred by the petitioners in the petition that 336 vacancies of teachers were advertised in Udhampur District out of which 290 candidates have been appointed and 46 posts have not been filled up. The grievances of the petitioner is that they are in the waiting list and they have right to be appointed against the said posts. The under secretary to Government Education Department vide communication dated May 9, 2008 has requested the Secretary SSRB to withdraw 46 posts of teachers in District Udhampur out of 336 posts. Court stayed the communication dated May 9, 2008 so far as it relates to withdrawal of 46 posts out of 336 posts of teachers in District Udhampur for which selection process has been completed shall remain stayed till next date of hearing.
