| Court granted bail to accused facing trial in dowry death case | | |
Jammu, September, 20:- Second Additional Sessions Judge Jammu Mr. AK Koul today granted bail to Kuldeep Raj s/o Thakur Dass r/o Samba, who is facing trial in a dowry death case with the direction that the accused be released from the jail provided he furnishes bail bond to the amount of Rs 50,000/- and surety in the like amount.
While granting bail Mr. AK Koul after hearing Advocate Anju Bala appearing for the petitioner and APP for the State whereas APP resisted the bail on the ground that the petitioner is involved in very serious crime u/s 306/498-A RPC and so granting him bail would mean releasing the accused who has forced none other than his wife to commit suicide. On the other and advocate appearing for accused submitted that accused has been in the jail so three kids are left behind alone and there is no body to take care of them, held that petitioner Kuldeep Raj is facing charge u/s 498-A/306 RPC charge has already been farmed against him and the trial has commenced. The question is can the petitioner be enlarged on bail in this situation when the trial has just started. The petitioner is in jail since almost four months and is further detention may not serve any useful purpose. It is the cardinal principle that bail cannot be withheld as a measure of punishment and if bail is declined in this case, it would be definitely amount to punishing the petitioner unhurt. With these observations Court granted bail to accused.
