HC directs preservation of GPS locations, CDRs in tehsildar trap case

JAMMU, Nov 4: The High Court of Jammu and Kashmir and Ladakh, sitting in Jammu, has issued orders to preserve GPS locations and call detail records of Officers/Officials of A.C.B Rajouri and the complainant, including the petitioner, Rohit Sharma, who was the Tehsildar Bahu at the time.
The High Court made this directive during the hearing of a petition filed by Rohit Sharma, represented by Senior Advocate Sunil Sethi and Advocate Parimoksh Seth. The court has instructed the Central Bureau of Investigation (CBI), the present investigating agency, to ensure the preservation of call detail records and GPS locations of the members of the Trap team, the then S.S.P A.C.B Rajouri, and others from November 1, 2022, which is the date of filing the complaint, to November 15, 2022, when the impugned F.I.R was registered and executed.
The petition filed by Rohit Sharma challenges the registration of F.I.R No 02/2022 by the Anti-Corruption Bureau (A.C.B) Rajouri, alleging a violation of government orders regarding the jurisdiction of the A.C.B Police Station. The petitioner also claims that the entire trap proceedings were conducted in a fake, dramatized, and highly motivated manner by a Deputy Superintendent of Police (Dy SP) and his team, as evident in the CCTV footage, which has been submitted as part of the court record.
During the court proceedings, Senior Advocate Sunil Sethi and Advocate Parimoksh Seth argued that a transparent, free, and fair investigation is a matter of right for the accused petitioner, Rohit Sharma. The petition seeks to uncover any criminal conspiracy and procedural lapses conducted by the A.C.B Rajouri in the registration and execution of the impugned F.I.R, allegedly in collusion with the complainant, who is facing multiple separate criminal F.I.Rs related to forgery of revenue records, criminal conspiracy, and more.
