DB directs SSB to redraw merit for audio-visual technician posts, frame final select list anew

JAMMU, Nov 7: A Division Bench of Jammu & Kashmir and Ladakh High Court, consisting of Justice Sanjeev Kumar and Justice Puneet Gupta, has directed the Service Selection Board (SSB) to redraw the merit for Audio-Visual Technician posts. This decision comes after considering the fact that both the petitioners are eligible for the posts in question. The court has also instructed the SSB to frame the final select list afresh. The SSB is expected to issue the select list within two months to expedite the appointment of selected candidates.
This petition was filed by the petitioners under Article 226 of the Indian Constitution against an order and judgment of the Central Administrative Tribunal, Jammu Bench, Jammu. The tribunal had dismissed the petitioners' challenge to the selection of respondent Nos. 6 and 7 as Audio-Visual Technicians in Government Medical College, Rajouri, and as Telephone Supervisors and Audio-Visual Technicians in GMC, Anantnag, respectively.
The Division Bench concluded that the qualification of a Degree in Electronics and Communication held by the petitioners is higher than the minimum qualification prescribed in the Advertisement Notifications, which is a Diploma in Electronics and Communication. The higher qualification of the petitioners in Electronics and Communication encompasses the minimum qualification required for the posts in question. Therefore, the tribunal incorrectly ruled the petitioners ineligible for the posts.
As a result, the Division Bench allowed the petition, set aside the order of the tribunal, and issued a writ of certiorari to quash the tribunal's order. The Division Bench also issued a writ of mandamus, directing the respondent-Board to redraw the merit list, taking into account the eligibility of both petitioners for the posts, and frame a new final select list. It has urged the respondent-Board to issue the select list within two months to expedite the appointment of selected candidates. If it is possible to accommodate the petitioners without disrupting the existing selections, the official respondents are advised to proceed accordingly.
This judgment is significant as it rectifies an erroneous decision regarding the eligibility of the petitioners for the Audio-Visual Technician posts and ensures a fair selection process.
