Early Times Report
JAMMU, Nov 17: Additional Munsiff Samba Urvashi R Bhargav rejected the bail applications of Sat Pal, Darshana Devi, Lovely Rani and Parshotam Lal allegedly involved in dowry death case. According to the police report that the accused/applicant is involved in FIR No. 69/2023 registered at Police Station Ramgarh for commission of offence under section 304-B/313 IPC. As per the report, on 22.06.2023, an information was received in the P/S from reliable sources that a lady namely Jyoti Devi W/o Kala Ram R/O Redwan Tehsil Ramgarh, who was earlier referred from CHC Ramgarh to SMGS Hospital, is brought dead and her dead body is lying in her residential house at Redwan. Since the death of a human being occurred in suspicious condition so the actual cause of death is required to be ascertained and, therefore, in order to ascertain the cause of death, an inquest proceeding U/S 174 CrPC was initiated and upon investigation, it was found that the deceased namely Jyoti Devi W/o Kaka Ram R/o Redwan was subjected to cruelty and harassment in connection with the demand for dowry by her in laws i.e., husband Kala Ram, brother-in-law Sat Pal and Bodh Raj All S/o Parkash Chand, sister-in-law Lovely Devi W/o Sat Paul and Darshana Devi W/o Bodh Raj All R/o Redwan and in continuation to those harassment, she and her still born baby died within 7 years of marriage, as such, offence under Section 304-B/313 IPC was proved against Kala Ram, Sat Pal, Parshotam Lal @ Bodh Raj All sons of Prakash Chand, Lovely Devi W/O Sat Pal and Darshana Devi W/O Parshotam Lal @ Bodh Raj. Additional Munsiff Samba Urvashi R Bhargav after hearing Adv Ganesh Sharma for the applicants whereas APP Vandana Sharma for UT, while rejecting the bail applications, observed that it is seen that the gruesome death of the deceased Jyoti Devi was pursuant to the incidents of domestic abuse with regard to demand for dowry when she was carrying an 8 month old fetus who lost his life alongwith the mother. The statements of the witnesses which have already been recorded prima facie disclose the involvement of the applicants, as such, release of the applicants at this stage is not merited as the applicants are accused to have committed a grave crime of dowry death, which is a social evil and that the personal liberty of the applicants has to be balanced with the public interest.
