| PIL on shifting of Toshakhana from Mubarak Mandi disposed off | | | Early Times Report Jammu, Feb 09-In a Public Interest Litigation filed by different organizations regarding shifting of Toshakhana from Mubarak Mandi Jammu, the Division Bench of J&K High Court Jammu Wing, comprising Chief Justice Barin Ghosh and Justice Nirmal Singh, has observed that since Advocate DK Khajuria appearing for the petitioners submitted that the present PIL has awaken the respondents to the satisfaction of the petitioners and the respondents have taken the required steps, accordingly the PIL is disposed off with the direction to the respondents to keep vigil over the matter. This PIL has been filed by VK Chopra Chairman Common Cause J&K, Inderjeet Khajuria President Jammu Development Council, Ram Pal Sharma President Dogra Front, Udhay Chand President Duggar Pradesh Development Council, Rajiv Chuni President Refugee Front seeking directions to the respondents not to shift Toshakhana from Mubarak Mandi Jammu and keeping the Toshakhana in safe custody inside building at Mubarak Mandi Jammu, publishing the inventory of all the articles of Toshakhana for information of general public, besides making arrangements for displaying the articles of Toshakhana once a month for general public so that they are aware about the heritage of people of Jammu and Kashmir. During the course of arguments Advocate DK Khajuria submitted that rulers of J&K State preserved and collected many precious articles i.e. old paintings, jewelry, arms in the shape of sword, daggers, palkuins, gold articles in the shape of gold bricks, golden thrones and many other precious and valueless articles which were preserved in Toshakhana situated at Mubarak Mandi Jammu. That a fire broke-out in the Toshakhana and the cause of the fire has not been made to the public, there are rumours that the fire was a sabotage for which the petitioners and other organization of Jammu had asked for a thorough probe and prayed before the Court for issuance of direction to the respondents not to shift the Toshakhana from Mubarak Mandi Jammu. In the objections filed by the State through Additional Advocate General AH Qazi in which, besides other points, has been submitted that the Government is very careful in the matter of preservation of these precious, antiques and in this view of the matter, they kept these items under proper control and supervision in the civil secretariat till permanent arrangement was made for their shifting back to the Mubarak Mandi where a most safe place shall be carved out under the new scheme of construction undertaken for Mandi Mubarak complex. It was further submitted by the state that all the precious, antiques and other articles including jewelry preserved in the Toshakhana were displayed to the media persons on December 21, 2006 before their shifting to the strong room of civil secretariat. The Division Bench, after considering the points raised in the PIL and objections filed by the State, disposed off the PIL. JNF
