| Charas smuggler’s bail rejected | | | Early Times Report
Jammu, Feb 10- Rejecting the bail application of one Ashok Kumar resident of Bakshi Nagar, facing trial for possessing three kilogram of charas u/s 20 NDPS, the Principal Sessions Judge Jammu SS Sarangal, after hearing both the sides, said that the accused is involved in an offence which is against the society and is an offence for which punishment is rigorous imprisonment for a term not less than 10 years and fine Rs 1 lakh extendable to 20 years and Rs. 2 lakh as fine. Moreover, the contraband allegedly recovered from the accused is three kilogram which is a commercial quantity and accused cannot claim bail in such an offence which is against the society and heinous in nature. Releasing the accused on bail at this stage, there is every likelihood that he may jump over the bail and will temper with the prosecution evidence which will send wrong signals to the public hence the bail application is rejected. According to the brief facts of the case on October 11, 2007, accused who was coming out of a street carrying a bag in suspicious circumstances was captured on spot and taken into custody. Upon his search three kilogram of charas was recovered from his possession and after completion of the investigation challan was presented against the accused u/s 20 NDPS Act. Later on accused was charged by Court u/s 20 NDPS Act on March 3, 2008. JNF
