High Court issues additional directions on PIL regarding Transport

SRINAGAR, SEPTEMBER 20 – The Division Bench of the State High Court comprising Mr. Justice B. A. Khan and Mr. Justice Bashir A. Kirmani Judge in a case titled Kashmir Consumer Welfare Forum V/S Commissioner, Transport and others has given additional directions/observations saying, “We are not impressed by steps taken by the Government, be that through Coordination Committee or the concerned Nodal Officer, in connection with creation of CNG infrastructure in the State. The status report filed Managing Director, SIDCO shows that the subject was not being approached in its right perspective. We are, therefore, constrained to direct Commissioner/Secretary to Government, Industries Department (Nodal Officer) to pursue the matter with GAIL authorities vigorously and to finalize dates with the new CMD, GAIL or any other competent authority for execution of requisite agreement. CMD, GAIL or any other competent authority involved, is directed to take in regard the orders passed by this Court from time to time qua them and to attend to the request of Jammu and Kashmir Government through Nodal Officer for completion of requisite formalities. The Nodal Officer shall have two weeks’ time to pursue the matter with competent authority of the GAIL and to take steps for execution of requisite agreement on a date to be mutually fixed;
The Transport Commissioner, who is also the Member Secretary Coordination Committee, has filed a consolidated report showing compliance in respect of directions passed by this Court from time to time. It is submitted by him that road from Batmaloo to Aloochi Bagh stands upgraded upto a certain point. Beyond that, the road required widening at certain places for which a project report had been prepared which was considered by the Government but had been referred back to Chief Engineer, PWD for review and resubmission. The Chief Engineer concerned is, accordingly, directed to resubmit his plans and estimates in this regard to the concerned competent authority of the Government within ten days from receipt of this order which shall be placed by such authority before the Coordination Committee for necessary clearance and sanction.
Registrar Judicial is directed to supply copies of this order to all concerned and seek their compliance. All Concerned authorities are directed to submit their status reports one week before the next date of hearing.
