| Rehab of PoK displaced | | HC issues notice to Govt | | Early Times Report
Jammu, Feb 13- In a petition filed by Devi Dass and other displaced persons from Pakistan Occupied Kashmir (POK), who left behind properties in that part of J&K during the 1947, seeking their rehabilitation in Jammu and Kashmir,, Justice Hakim Imtiyaz Hussain of Jammu and Kashmir High Court today issued notice to the respondents returnable within a period of three weeks and in the meantime directed respondents to consider the representation of the petitioners and pass appropriate orders. The petitioners submitted that the State Government had allotted the state as well as Evacuees land available at the relevant time vide different Government orders which was in possession of the defence forces much prior to the allotment. Later on the Custodian General cancelled the allotment order, which was cause of the litigation. In the present petition in which Advocate Sanjay Sharma appeared for the petitioners submitted that petitioners being the displaced persons were earlier allotted agriculture land for their rehabilitation. The said allotment was cancelled by the Custodian General which forced the petitioners to file petitions, the said petitions were disposed off vide the common judgment February 20, 1998, ultimately the matter was settled by the Apex Court vide order January 13, 2003. Counsel for the petitioner further submitted that petitioners have moved a representation for their rehabilitation as warranted under Government order No 578-C of 1994 but respondents are not considering the same, upon this, Justice Hakim Imtiyaz Hussain issued notice to the respondents returnable within a period of three weeks and in the meantime directed respondents to consider the representation of the petitioners and pass appropriate orders.
