Langate MLA’s election: HC issues notice to EC

Jammu, Feb 18: The Jammu and Kashmir High Court Wednesday directed Election Commission of India and 16 other respondents to file objections within a week in a petition filed by Peoples Democratic Party candidate from Langate calling for election of the independent candidate from the constituency "be declared null and void" for holding "Office of the profit."
After hearing the counsel for petitioner, Muhammad Sultan Panditpori, Justice Manzoor Ahmad Mir directed Secretary Election Commission of India, Nirvachan Sadan, Chief Horticulture Officer Handwara—Returning Officer— Avtar Singh, Managing director JK projects construction Corporation limited, separatist turned politician Engineer Abdul Rashid Shiekh and twelve other candidates who contested from the Langate constituency, to file the objections to the petition.
In its petition filed through his counsel Jahangir Iqbal Ganai, Panditpuri has alleged that the election of Sheikh Abdul Rashid is void and is required to set aside because the separatist turned politician was working as a manager in the JK PCC at the time of scrutiny of papers. "He was disqualified to be chosen to fill a seat in the Legislative Assembly in terms of the mandate of section 24-D of the JK representation of Peoples Act, 1957."
"His nomination papers were improperly accepted by the returning officer in the violation of the mandate of section 69 (1)(i.e) of the constitution of the state," reads the petition.
Panditpuri, who lost the elections from the constituency by meager 210 votes against separatist turned politician Engineer Abdul Rashid Shiekh, has prayed before the court that the election of Sheikh be declared void and election be set aside.
Besides, Panditpuri has also demanded that he be declared as "duly elected" to the single member constituency in the north Kashmir's Kupwara district.
Once a close confidant of the slain pro-freedom Hurriyat leader Abdul Gani Lone, Engineer Sheikh joined Sajjad Lone after the People's Conference leader was assassinated and his party split between his two sons- Sajjad Gani Lone and Bilal GAni Lone. Sheikh parted ties with Sajjad after he announced poll boycott campaign.
