Court awards life-imprisonment to four in murder case

JAMMU, Jan 24: 1st Additional Sessions Judge Jammu Virender Singh Bhou today awarded life-imprisonment to four namely Deepak Singh alias Deepu S/o Ramesh Singh, Manjeet Singh alias Sonu S/o Surjeet Singh, Shammi Singh alias Chhottu S/o Ravi Singh, Charanjeet Singh alias Rocky S/o Surjeet Singh all residents of Satrayian Tehsil R.S.Pura Distt. Jammu facing trial in murder case for the last 10 years.
The alleged enmity between the deceased's family and accused's family has resulted into the death of Vinod Kumar, hereinafter referred to as deceased, as alleged by the Prosecution. The prosecution story as unfolded from the final report, statements of the witnesses and material on record is that on 08-07-2014, at 15 hours (3 PM), the complainant in the case, P.W Anil Sharma, son of Tirath Ram, real brother of the deceased, namely, Vinod Kumar, lodged a written report before the Police of Police Station R.S. Pura, that he is a resident of Village Satrayian and is a business man by profession. Accused Deepak Singh, son of Ramesh Singh, Manjeet Singh and Charanjeet Singh, sons of Surjeet Singh, all residents of Village Satrayian, was having enmity with him and his brothers. On 08-07-2014, approximately at 02:15 p.m., Vinod Kumar, while the real brother of the complainant, was sitting in his shop, situated at Ward No. 12 and was watching television, the real uncle of the complainant, Vijay Kumar, was also sitting in his shop which was situated opposite the shop of the complainant. When the complainant, after having his day meals, reached at his shop, he saw accused Deepak Singh, Manjeet Singh, Charanjeet Singh alongwith one unknown person, on account of old enmity, entering the shop of the complainant having gun and sharp-edged weapons in their hands. They attacked Vinod Kumar with common intention to kill him inside the shop. Whereas accused Deepak Singh was having a gun in his hands, the rest of the accused were having sharp edged weapons (Tokas) in their hands. On the alarm raised by the complainant and his uncle, accused Deepak Singh fired from the gun and caused serious injuries to Vinod Kumar. Thereafter all the accused persons ran away from the place of occurrence. The injured brother of the complainant was thereafter taken to the Govt. Hospital, R.S.Pura, by his uncle Vijay Kumar and others. After his checkup the injured Vinod Kumar was declared as brought dead. On his written report the Police of Police Station R.S.Pura, on 08.07.2014, at 15.00 hours (3p.m), registered FIR Number 132 of 2014, under Sections 452, 302, 34 of the Ranbir Penal Code and section 3/25 and 4/25 of the Arms Act.
Ist Additional Sessions Judge Jammu Virender Singh Bhou after hearing both the sides observed that The convicts, namely; 1. Deepak Singh alias Deepu S/o Ramesh Singh R/o Village Satrayian Tehsil R.S.Pura Distt. Jammu, therefore, is sentenced to undergo rigorous imprisonment for life for the commission of offence under section 302 RPC and pay a fine of Rs. 10,000/-. In case of default of payment of fine the convict shall undergo further simple imprisonment of two months. He is further convicted for the commission of offence under sections 452 RPC to undergo rigorous imprisonment of 2 years and pay a fine of Rs. 1000/- and in default of payment of fine he shall undergo simple imprisonment for one month. He is further convicted for the commission of offence under Section 30 I.A.Act to undergo rigorous imprisonment for two months and pay a fine of Rs. 1000/-and in default of payment of fine, he shall further undergo simple imprisonment for 15 days. All the sentences shall run concurrently. Convicts namely; 2. Manjeet Singh alias Sonu S/o Surjeet Singh, 3. Shammi Singh alias Chhottu S/o Ravi Singh & 4. Charanjeet Singh alias Rocky S/o Surjeet Singh All residents of Satrayian Tehsil R.S.Pura Distt. Jammu shall undergo rigorous imprisonment for life for the commission of offence under section 302 RPC and pay a fine of Rs. 10,000/- individually. In case of default of payment of fine the convicts shall undergo further simple imprisonment of two months individually. They are further convicted for the commission of offences under sections 452 RPC to undergo rigorous imprisonment of 02 years and pay a fine of Rs. 1000/-individually and in default of payment of fine they shall undergo simple imprisonment for one month individually. They are further convicted for the commission of offence under Section 4/25 I.A.Act to undergo simple imprisonment for one year and pay a fine of Rs. 1000/- individually and in case of default of payment, they shall further undergo imprisonment for 15 days individually. However, all the sentences shall run concurrently. —JNF
