Jammu, Feb 21- A Division Bench of J&K High Court Jammu Wing comprising Chief Justice Barin Ghosh and Justice Virender Singh in a Public Interest Litigation filed by residents of Shastri Nagar Jammu alleging encroachment of Park by the PDD for the construction of office appointed Advocate Ved Raj Wazir as Commissioner for the purpose of making inspection of the locality and reporting back to the Court of the exact state of affairs as available on the date of his visit. DB further ordered that no further construction be made and the parties are directed to maintain status quo on spot as on February 13, 2009. With these directions DB adjourned the matter for three weeks. This PIL has been filed by Kanwarjeet Singh and Ors residents of Shastri Nagar Jammu against the encroachment of Park for the construction of office of PDD without seeking NOC from the Housing Board and JMC. In the PIL filed through Advocate WS Nargal it has been alleged that despite the demolition of illegal structure raised by the PDD on April 17, 2008 in presence of Duty Magistrate, Estate Officer with the assistance of police yet said demolition was not completed due to the fact that the official record was lying in the said building. A request was made to the concerned Executive Engineer to remove the official record from the building within four days failing which the PDD will have no claim on the said record and it shall be their personal responsibility. It was further alleged that the illegal encroachment was partly demolished; the PDD authorities again started construction work on the demolished structure at the behest of concerned Minister who became hostile and furious against the housing board that were instrumental in demolishing the said structure.
