HC comes to rescue of ZE transferred thrice in a month

Jammu, Feb 21- Justice Nirmal Singh of J&K High Court Jammu wing today stayed the transfer order of Upinder Razdan Incharge ZEO Bhalwal who was transferred from Bhalwal to Hiranagar on February 20, 2009.
After hearing Advocate SK Shukla appearing for the petitioner, Justice Singh issued notice to respondents' returnable within four weeks and in the meanwhile, subject to the objections of other side, order impugned February 20, 2009, qua, the petitioner shall remain stayed, the court ordered.
In the petition it has been submitted that petitioner came to be promoted as Incharge ZEO vide Government order January 19, 2009 and was posted as Incharge ZEO Akhnoor. Petitioner joined his duty on January 21, 2009 when the Commissioner/Secretary Education Department issued another order thereby transferring the petitioner from Akhnoor to Bhalwal Zone with a view to adjust one Gurdev Singh. The petitioner joined Bhalwal on January 22, 2009. The petitioner had not even completed his tenure of one month as Incharge ZEO Bhalwal; when he was again transferred vide Government order dated February 20, 2009. According to the petitioner this order was passed at the behest of one Romesh Chander, who on being transferred as ZEO Hiranagar, had failed to join his duty and had managed the modification. The petitioner alleged that the Commissioner Secretary Education Department, with a view to oblige the said respondent, who had the support from political dispensation, issued the order impugned thereby transferring the petitioner as Incharge ZEO Hiranagar. It was further alleged that the petitioner has been transferred thrice within a span of less than one month and the order impugned has been passed not to sub-serve any interest of administration but to interest of political dispensation, who is hell bent upon to adjust their blue-eyed persons at the places of their choice.
