High Court takes suo-moto PIL on stray dog menace in Ladakh

JAMMU, Feb 13: In response to the growing concerns over the stray dog menace in Ladakh, the Jammu & Kashmir and Ladakh High Court has initiated a suo-moto Public Interest Litigation (PIL) to address the issue. The court, led by Chief Justice N. Kotishwar Singh and Justice MA Chowdhary, expressed alarm over the escalating number of dog bite cases, which surged from 854 in 2017 to 2229 in 2022, with 220 incidents reported in January 2023 alone. This spike in cases has not only instilled fear among the local populace but also raised safety concerns for tourists.
The Division Bench, acknowledging the gravity of the situation, has decided to closely monitor the matter. They directed the Union Territories (UT) of Jammu & Kashmir and Ladakh to submit detailed updated status reports by February 21, 2024. The court emphasized the importance of implementing the Animal Birth Control Rules, 2023, as notified by the Department of Animal Husbandry and Dairying on March 10, 2023.
During the proceedings, Ms. Devinder Kour, representing Save Animal Value Environment (SAVE), raised concerns about the inadequate implementation of the ABC Rules, 2023. It was noted that the State level Monitoring Committee, mandated to oversee the implementation of these rules, has not been functioning effectively. Moreover, there is a lack of awareness regarding dog bite incidents and the availability of anti-rabies vaccines.
SAVE also highlighted the importance of implementing the Prevention of Cruelty to Animals (Pet Shop) Rules, 2018, and Prevention of Cruelty to Animals (Dog Breeding and Marketing) Rules, 2017, to mitigate instances of stray dog bites. The Division Bench stressed the need for regular meetings of the State Level Monitoring Committee and directed authorities to ensure their proper functioning. The court reiterated its commitment to closely monitor the situation and scheduled the next hearing for February 21, 2024, emphasizing the submission of detailed updated status reports from both UTs. The court's proactive approach underscores the seriousness with which the issue of stray dog menace in Ladakh is being addressed, aiming to ensure the safety and well-being of residents and visitors alike.
