Udhampur, Feb 28: Honble Principal Sessions Judge Udhampur today awarded 14 years rigorous imprisonment and fine of Rs 25000 to Subash S/O Sukhdev R/O Khogad Marh, Ramnagar, District Udhampur , in case of rape with minor girl on 19.09.2017.
The Principal Sessions Judge Udhampur after hearing Public Prosecutor and counsel for the accused said that the prosecution has successfully proved the charges against the accused beyond any doubt. Honble Judge observed that the victim was a minor girl of 08 years who had gone to shop and after buying a biscuit packet was coming to her maternal grand mother's house, when one person met her on the way, who she did not know and told her that he is her maternal uncle (Mamu) and gave her eatable article. Thereafter he took her in the bushes and gagged her mouth with his hand and committed rape upon her. Rape is not just a physical condition but a crime which completely demolishes or destroys the victim and her family.
So, taking all the relevant facts and circumstances into the consideration, and also keeping in mind the aggravating and mitigating circumstances of this case, the convict shall undergo 10 years rigorous imprisonment and a fine of Rs. 10,000/- (ten thousand rupees) for the commission of offence under Section 363 RPC. He shall further undergo rigorous imprisonment for 14 years and a fine of Rs.15,000/- (fifteen thousand rupees only) for the commission of offence under Section 376 RPC. Both the sentences shall run concurrently. In default of payment of fine, the convict shall further undergo rigorous imprisonment for six months.
