| Bad blood: NC leader challenges election of Congress’ Doda MLA | | |

Jammu, Feb 24: In a reflection of bad blood between the coalition partners, a National Conference leader has challenged the election of a Congress legislator on technical grounds. On an election petition filed by for Doda MLA and NC leader Khalid Najib Suharwardy, who unsuccessfully contested as NC candidate from Doda in 2008, challenging the election of Abdul Majid Wani of Congress as MLA, Justice YP Nargotra of J&K High Court Jammu Wing today issued notice by Dasti and directed Registry to list the election petition after completion of service process. After hearing Senior Advocate Sunil Sethi assisted by Advocate Veenu Gupta, Justice Nargotra dictated the order in the open Court, show cause as to why petition be not admitted to hearing. In the petition it has been alleged that Abdul Majid Wani who was elected MLA from Doda in the recently held Assembly election on Congress ticket was a registered contractor with the State Forest Corporation and in the year 2002 he had submitted “NOC” from the said corporation that he does not owe anything to the said corporation before filling nomination for the assembly election. The petitioner alleged that said respondent managed this certificate by manipulation of the facts in connivance with the certain senior officials of the SFC including then General Manager (ADM) who issued this certificate fraudulently to facilitate the said respondent in contesting the election, since in the absence of said “No Objection Certificate” he could not have contested the election being a subsisting contractor. Though Wani owed more than Rs 177 lakhs to the said Government undertaking, the fact of there being a huge outstanding against the said respondent that he obtained “NOC” fraudulently came to light when said General Manager was placed under suspension for issuance of NOC and Managing Director within 20 days of issuance of “No Objection Certificate” withdrew the same. In the petition the petitioner claimed that Wani is still a contractor and also referred a order of State Accountability Commission that serious illegalities and frauds committed by officials of J&K SFC in connivance with Wani is under investigation of J&K Accountability Commission in complaint filed by Bal Krishan Bhagat Vs Abdul Majid Wani & Ors. SAC had appointed an officer of the rank of DIG to investigate various acts of commission and omission committed by Wani and some others. It is evident from the said report that DIG concerned had established that there is a liability of Rs 177 lakhs against Wani which deals with some contracts and all such contracts have not been concluded because of the said reasons and the said contracts are still subsisting. In the petition, the petitioner submitted that Wani filed affidavits in which he mentioned that he is an accused in FIR 77/1993 but deliberately gave no further details of the cases. The petitioner further submitted that three FIRs bearing No 66/80, 12/93 and FIR No 83 stand registered in Poilice Station Doda were being investigated by the police in which Wani was an accused. Wani who in his nomination form and the affidavits have deliberately and willfully concealed the said information is liable for action, the petitioner submitted a prayed before the court to declare the election of Wani as null and void and declare the petitioner as having been duly elected as MLA of Doda Assembly segment securing second highest number of vote polled.
