HC notice to Center as LS seat sought for SCs, STs

Jammu, Feb 25-In the larger interests of the Scheduled Caste and Scheduled Tribe community, Justice Mansoor Ahmed Mir of J&K High Court Jammu Wing today allowed the petition seeking reservation of one seat of Lok-Sabha in J&K out of six seats. The Court issued notice Union of India through Secretary to Ministry of Parliamentary Affairs, Election Commission of India, Ministry of Law and Social Justice Union of India and State of J&K through Chief Secretary returnable with in a period of three weeks and also permitted Dasti Service.
This petition filed in the larger interest of the Scheduled Caste and Scheduled Tribes community through Chaman Lal Kanathia and others in which Adv Roop Lal appeared for the petitioners submitted that the petitioners are seeking reservation of one seat of Lok-Sabha for the SC/ST Communities which was requirement of law as per the constitution of India. He further submitted that six seats have been kept for the state of J&K for electing members to the house of People which is going to be held in the near future for constituting 15th Lok-Sabha.
The Advocate further submitted that in other neighboring states, seats have been reserved for the scheduled caste and scheduled tribe but no reservation has been provided in J&K State during the last 59 years of independence since implementation of the Constitution of India on January 26, 1950, although such a provision has been provided in the constitution of India. The petitioners seeking direction to the respondents restraining them from the conducting ensuing Parliamentary Elections in J&K for constituting 15th Lok-Sabha going to be held in near future, without keeping one seat reserve for scheduled caste and scheduled tribes and also seeking direction to respondents for reserving one Lok-Sabha seat in J&K for the ST/SC Community under Article 330(1) and J&K (2) r/w Article 341 of constitution of India.
