HC adjourns delimitation case for March 12

Jammu, Feb 25- A writ petition filed by the Jammu and Kashmir National Panthers Party on the most burning issue of Delimitation of State Assembly Constitutes in the State has come up for bearing before a Division Bench of Jammu and Kashmir High Court comprising Chief Justice Biren Ghosh and J.P. Singh.
The petition being of important nature the court decided to have a thorough discussion on the subject and directed that the case be listed for March 12 .
Vehemently arguing the case, Prof. Bhim Singh submitted before the court that the State Legislature has acted beyond its competence and jurisdiction by enacting a highly discriminatory and arbitrary law putting a freeze on the Delimitation of the Assembly Constituencies for literally 35 years thus destroying the basic structure of the Constitution and denying the fundamental rights of more than 10 millions people of Jammu and Kashmir.
Prof. Singh, who argued for 90 minutes, urged the court to declare the State law banning Delimitation as ultravires of the constitution. He also expressed shock on the constitutional fraud committed by the Union of India and the State by practically debarring National Delimitation Commission to extend the Delimitation of Lok Sabha Constituencies in J&K.
Prof. Bhim Singh was assisted by Advocates H.C. Jalmeria, B.B. Kotwal and Bansi Lal Sharma in the matter.
Prof Singh further informed the court that there has been grave violation of the Constitution and the fundamental rights of the electorates of J&K by the misuse of Article 370 by the State government. He told the court that there are two Lok Sabha constituencies in Jammu province and four in the province of Kashmir, besides 37 Assembly Constituencies in Jammu province and 50 in Kashmir alley when the number of electorates in Jammu province is more than the number of electorates in the Valley.
