| Electricity Magistrate takes serious note of SHO’s action, orders proceedings | | | Early Times Report
Jammu, Feb 27- Taking serious note of the action of SHO Police Station Jhajjar Kotli and the manner in which the custody of the accused has been transferred by the Jhajjar Kotli, the Electricity Magistrate MK Sharma observed Court is constrained to say that the act is unbecoming of a responsible police officer and let separate proceedings for initiation of the disobedience of the Court order and not following the procedure of law in handing over the custody of accused, be initiated against the SHO P/S Jhajjar Kotli.. The Electricity Magistrate further observed that to keep arresting the accused after his release on bail is uncalled for and creates doubts in the investigation of the case. In the present case the arrest of the accused in case FIR 127/2008 and his subsequent release and immediate transfer of custody from P/S Jhajjar Kotli to PP Sidhra without mentioning the FIR in which case accused is handed over to the PP Sidhra, smacks of malafides on the part of the SHO P/S Jhajjar Kotli. In the order Electricity Magistrate, after hearing Sr. PO DP Singh appearing for the State and Adv Rajneesh Oswal appearing for the petitioner/accused observed that the accused Kali Dass was released by the order of this Court in case FIR No 130/2008. It appears that he was simultaneously arrested in case No 130 and was remanded to police custody by the Executive Magistrate Jammu from February 20, 2009 to February 26, 2009. During the police custody the SHO P/S Jhajjar Kotli handed over the accused to P/P Sidhra. The case dairy filed in FIR No 127/2008 reveals that the accused was released in terms of section 169 Cr PC. The CD file does not mention in which case the accused has been arrested by the police post Sidhra. JNF
