| DB upholds decision of single judge in Babu Singh’s eviction case | | |

Jammu, Feb 27 A Division Bench of J&K High Court Jammu Wing comprising First Puisne Judge Nisar Ahmed Kakru and Justice Sunil Hali today upheld the order of Single Judge in a petition filed by Jatinder Singh alias Babu Singh former minister and MLA against the eviction from Government quarter at Kathua.
The judgment written by First Puisne Judge Nisar Ahmed Kakru for the Division Bench and this approved for reporting judgment announced by Justice Sunil Hali, in which the Division Bench after hearing Adv BS Salathia for appellant, observed that the petitioner in the capacity of MLA had sought allotment of Government quarter because of insufficiency of his accommodation and not on threat to his life. The DB also decided various points raised in the LPA and also allotment order DCK/PA/08-09/278-80 dated January 20, 2009 in favour Charnjit Singh Jasrotia constituency successor of the petitioner as MLA, yet petitioner/appellant has chosen not to implead him as party respondent why such omission, explanation is wanting. With these observations the Division Bench find nothing wrong with refusal by the Single Judge to exercise the discretionary power to advantage of the petitioner/appellant and dismissed LPA along with CMP.
