HC directs authorities to provide status update on appointment of Child Rights Committee members

JAMMU, Apr 1: A Division Bench of the Jammu & Kashmir and Ladakh High Court, comprising Chief Justice N Kotishwar Singh and Justice Mohammad Yousaf Wani, expressed concern over the apparent lack of progress in the appointment process for members of the Protection of Child Rights Committee. The bench emphasized the vital statutory role the Commission plays and underscored the need for concrete steps to be taken in this regard.
The bench issued a directive to the respondents, instructing them to promptly inform the court of the current status of the appointment process for Committee members by the next hearing. Failure to comply with this directive may result in the concerned officials being summoned to appear before the court in person to provide an explanation.
In its observations, the bench noted that despite previous orders directing updates on the constitution of the Jammu & Kashmir Commission for Protection of Child Rights, there has been a lack of clarity regarding the progress of the appointment process. Despite assurances from respondents' counsel on multiple occasions, including meetings convened in August 2023, no substantive information has been provided to the court regarding the outcome of these discussions or the status of the appointment process.
The bench reiterated the importance of expeditiously addressing this matter and expressed disappointment at the lack of tangible progress thus far. It emphasized the need for transparency and accountability in the appointment process to ensure the effective functioning of the Commission for Protection of Child Rights in Jammu & Kashmir.
