2 murder accused get life imprisonment

Jammu, Mar 4- The 1st Additional Sessions Judge Jammu Puneet Gupta today awarded life-imprisonment to accused Des Raj and Surinder Pal holding them guilty for commission of offence u/s 302 RPC.After hearing Additional Public Prosector Harpal Singh for the State and counsels for the accused persons, Additional Sessions Judge observed that taking into consideration all the relevant facts holding the accused Des Raj and Surinder Pal guilty for the commission of offences u/s 302 RPC sentenced both the accused to undergo imprisonment for life and fine Rs 5000 for the commission of offence u/s 302 RPC. The accused Des Raj is further sentenced to undergo imprisonment for a period of three years and fine Rs 2000 for offence u/s 25 of Arms Act. All the sentences shall run concurrently, the court ordered. According to the police case Asha Rani accused had married with the brother of the complainant namely Raj Kumar. It has been revealed that the deceased and his brother Narinder Kumar complainant had some shops at Hakal and the accused Asha Rani was claiming a share in those shops for which the complainant and the deceased were not ready. Asha Devi filed a civil suit against her younger brother-in-law and elder brother in law in the civil court. It is alleged that because of this litigation, the complainant and in order to remove Rajinder Kumar deceased and the complainant Narinder Kumar from the scene, she took help of the accused Des Raj alias Vicky, Subhash Chander his brother and Surinder Pal alias Pachi, the accused who had been coming to her house where they had hatched a conspiracy for finishing the complainant namely Narinder Kumar and the deceased Rajinder Kumar. It is alleged that as a result of conspiracy, having been hatched by all the accused. Des Raj along with two other accused had come on spot at Hakal to the shop of the complainant where accused Subhash and Rajinder Pal had caught hold of the victim Rajinder Kumar while as the accused Des Raj had assaulted and inflicted the grievous injury to Rajinder Kumar which resulted in his death. A case u/s 302/34 and r/w section Arms Action was registered at Police Station Stawari under FIR 83/98 dated June 25, 1998 on the verbal report of the Narinder Kumar brother of the deceased. Accused Asha Rani stands discharged by the court order dated October 17, 1998 whereas accused Subash Chander was acquitted by giving the benefit of doubt. JNF
