Court rejects bail in rape case

JAMMU, Apr 18: Munsiff Judicial Magistrate Ist Class Udhampur Maleeka Sharma today rejected the bail application of one Angrez Singh son of Dharam Chand resident of Barmeen Tehsil who was allegedly involved in rape case
According to the police case that the accused person has been arrested in a case registered vide FIR No. 11/2024 for the commission of offence under-Section 376 506 / IPC. Police report further reveals that on April 29.02.2024, the complainant reported to women Police station udhampur that she had relation with accused for last three years and that he has promised to marry the complainant b but then he refused after two years after which complainant stop contacting him but on 17,02,2024 called her and took her to local hotel in Udhampur and forcibly raped her and threatened to expose her on social media by clicking her pictures .
On this report, case under section 376/506 IPC came to be registered against the accused and investigation was set in motion
Munsiff Maleeka Sharma ` after hearing APP Geetangali Bhagat for the State and counsel for accused observed that the accused is alleged to have committed a serious offence of rape which is corroborated by complainant in her statement recorded under section 164 Cr Pc . moreover , the perusal of her statement U/S 164 CrPc reflects that she has made an allegation of rape being committed on her when she was minor in class 10th . I.O when called has also submitted that offences under section POCSO act are being made out and will be added soon and the investigation is in its initial stage .
Court observed that in the present case , there are prime faice sufficient grounds to presume the involvement of accused in alleged crime and moreover the investigation is not complete yet. As such in the wake of severity of crime and observations made herein above he accused cannot be released on bail in case With these observations, Court rejected the bail application.
