| On Samiti petition, CJ calls case record from Srinagar | | | Early Times Report
Jammu, Mar 06-Chief Justice of Jammu and Kashmir High Court Justice Barin Gosh today issued notice and called the record of SPW 1562/08 filed by Shalindra, the then Additional Superintendent of Police and Ors from Srinagar Wing to Jammu and ordered that no further steps shall be taken in the writ petition until further orders. These directions were passed in an application filed by Convener Shri Amarnath Yatra Sangarsh Samiti Jammu Lila Kiran Sharma seeking transfer of the petition from Srinagar High Court to Jammu High Court in which the High Court Srinagar Wing restrained the Justice OP Sharma Commission from finalizing the enquiry report in Kuldeep Kumar’s suicide case. In the transfer application it has been submitted that during the land row agitation started by Shri Amarnath Yatra Sangarsh Samiti, the police has committed atrocities on the innocent protesters and desecrated the body of martyr Kuldeep Verma, the police tried to lift body in the night and burn the same by desecrating the body causing disrespect to the body of Martyr Kuldeep Verma, hurting the sentiments of the family and other relatives of the Martyr and the public of Jammu. On the demand of the public projected by SAYSS, the Government appointed a Commission of Enquiry headed by Justice OP Sharma (Rtd) to find out cause which led to the death of Kuldeep Verma and subsequent act of desecration committed by the administration with the body of Kuldeep Verma and the persons responsible for the same. It has been alleged that the petitioners have deliberately filed the writ petition in the Srinagar Wing of High Court when the matter pertains to Jammu and place of sitting of the Commission is at Jammu. It was also submitted in the transfer application that the petitioners in the writ petition which is pending in the Srinagar have leveled allegations against the applicant LK Sharma convener SAYSS by name but have not impleaded as party in the said writ petition and the applicant has filed an application for impleading as party in the petition. In the transfer application it has been submitted that in the interest of justice and fair play that the writ petition SWP 1562/2008 be transferred from the Srinagar Wing of the High Court to Jammu Wing. It is worthwhile to mention here in the said writ petition the High Court at Srinagar Wing had issued notice to the State of J&K through Chief Secretary, Principal Secretary Law, Secretary Commission of Enquiry and Presiding Officer Commission of Enquiry appointed by SRO 218 dated July 28, 2008 with the direction to file objections by the next date of hearing till then steps to finalize the report shall defer.
