| Court acquits accused after 10 yrs of trial | | | Early Times Report
Jammu, Mar 9- Principal Sessions Judge Jammu SS Sarangal acquitted Sanjay Kumar from the charges of setting on fire the truck on March 5, 1999. After hearing Public Prosecutor EA Tak appearing for the state and Advocate LK Sharma appearing for the accused, Principal Sessions Judge observed that prosecution witnesses namely Zakir Hussain Mirza and Abdul have been declared hostile by the prosecution as they have stated nothing incriminating against the accused, further more prosecution has withheld important witnesses namely Vinod Kumar, Dr. R Thappa, Surjeet Singh and Mohammed Sadiq constable and non production of these witnesses has caused serious doubt about the prosecution story. The prosecution has not been able to prove the guilt beyond any reasonable doubt and as such accused Sanjay is acquitted of the charges leveled against him. According to the prosecution case on March 5, 1999 Police Station Jhajjar Kotli received information that one Harjeet Singh was driving truck from Jammu to Srinagar which was loaded with seven cows. Two persons namely Faiz Ahmed and Mohammed Ryaz were also in the truck and when the truck reached at Kotli, a mob about 200/250 persons came there and intercepted the truck and starting unloading the animals and beaten the above said persons. Mob also set on fire the truck and a scooter. On this information Jhajjar Kotli police registered a case U/Ss 435/341/323/147/148/353 RPC and started investigation. After completion of investigation presented challan against the accused Narinder, Sanjay Singh, Surinder Kumar, Jagdish Singh, Suram Singh, Kamal Singh and Manohar Lal in the court of law on July 29, 1999. It is worthwhile to mention here on the day of presentation of challan proceedings u/s 512 Cr PC were initiated against all the accused on the request of police. Ultimately the accused surrendered before the Court and the proceedings u/s 512 Cr PC initiated against the accused were dropped and accused were admitted to bail. Court after closing the prosecution evidence acquitted all the accused except Sanjay on April 17, 2008. JNF
