| Court summons SHO Khour, Naib-Tehsildar Akhnoor | | | Jammu, Sep 21: Chief Judicial Magistrate Sanjay Dhar has summoned Station House Officer Khour and Naib Tehsildar Akhnoor and asked them to appear before it so as to explain as how they bypassed an order issued by the court. The orders were passed following an application for grant of police remand to one Kuldeep Singh son of Dewan Singh resident of Pallanwalla, tehsil Akhnoor, who was arrested on a non-bailable warrants issued by the court. The application moved by the Chief Prosecuting Officer had prayed the police custody of the accused for the purpose of investigation of the case under FIR No 33/2006 for the offence under Section 498-A/306 RPC. Taking serious note of the alleged by-passing of the court order, the CJM observed that the accused Kuldeep Singh was arrested following a non-bailable warrants issued by the court with the direction that the accused shall be produced before the court immediately upon his arrest. The accused was arrested by the police on September 20 in complaint to the warrants and has been produced today before the court. After going through the Case diary it was observed that the accused was presented before Executive Magistrate First Class Akhnoor today in the morning and a remand of seven days has been obtained from the said authority. “I failed to understand when there was a clear cut direction by this court to prouce the accused before this court immediately upon his arrest, why he has been produced before the Executive Magistrate”, the court observed, while taking serious note of the act of the Magistrate who granted the remand despite the fact that the court order was part of the case file. “In these circumstances SHO Khour and Naib Tehsildar Akhnoor shall appear in person before this court or before successor of the undersigned tomorrow at 10 am and explain there position”, the court directed. |
