Court acquits attempt to murder accused for want of evidence

Jammu, Sep 21 : First Additional Sessions Judge Jammu GK Pandita today acquitted six persons, including a woman, - who were facing charges for alleged attempt to murder from last more than five years – for the lack of evidence against the accused.
The acquittal was made against Jagdev Raj, Satpal both sons of Hans Raj, Mangat Ram, Subhash Chander, Vijay Kumar all sons of Puran Chand and Pushpa Devi wife of Puran Chand all residents of Katal Batal, Jammu.
Passing the judgment, the court observed that the prosecution case has landed up in a “marshy where from it cannot take off”. “The foundation stone for dismantling the prosecution had been laid at the time of presentation of the challan in which the prosecution had not even cited its star witness (injured) Romesh in the list of the witnesses”, the court observed, adding “The prosecution case is on of dismissal and of no evidence”.
Sources told News Agency of Kashmri that the counsel for the accused Advocate Sabeel Mirza argued that the main witnesses in the case, Romesh Kumar, has turned hostile and even on his cross examination nothing could be elicited by the prosecution. “Even the witnesses to the occurrence have turned hostile and denied the allegations leveled against the accused and important witnesses have been held up by the prosecution as such inference should be drawn that had those witnesses turned up they would have denied the prosecution story”, the defence counsel argued further.
As per the police story a written complaint was lodged before Nagrota police station by Indu Bushan that the complainant along with his brother were attacked by the accused with sharp edged weapons when the duo was on its way towards Jammu on April 14, 2001.
The police registered a case for attempt to murder, unlawful assembly and under arms act against the accused and recorded the statement of the witnesses, collected samples from the spot and arrested the accused. It was claimed that during the investigation the accused also made a disclosure statement following which weapon of offence was also recovered by the police.
