Remand in Dowry Death Case
Court directed Executive Magistrate Akhnoor and SHO Khour to appear in person

Jammu, September, 21:- Chief Judicial Magistrate Jammu Mr. Sanjay Dhar today in a case of non bail-able warrants issued against accused involved in dowry death case with the direction to the Executing Officer to produce the accused in Court immediately upon his arrest. The Khour police today produced the accused before the Executive Magistrate Akhnoor, who remanded accused to seven days police custody, has directed Naib-Tehsildar Executive Magistrate and SHO Khour to appear in person in the Court tomorrow at 10:00 A M and explain their position.



Chief Judicial Magistrate Jammu Mr. Sanjay Dhar issued this direction wile dealing with an application made by CPO, Seeking police remand of the accused Kuldeep Singh in police custody for his custodial investigation. The accused as been produced in custody before this Court, it appears vide order August 22, 2006 a non bail-able arrest warrants were issued against accused Kuldeep Singh with a direction to Executing Officer to produce the accused before this Court immediately upon his arrest. The accused has been arrested on September 20, 2006 and as been produced today before this Court.



CJM after perusal of the case dairy reveals that accused has been produced before Executive Magistrate Ist Class Akhnoor today in the morning and remand of seven days has been obtained from the said authority. Upon this the Court took serious note of this position of the case and observed that Court failed to understand when there was a clear cut direction by this Court to produce the accused before this Court immediately upon his arrest, why he has been produced before the Executive Magistrate. It is also very strange that how Naib-Tehsildar Akhnoor has entertained the application and remanded the accused to seven days police custody without taking note of the order of this Court, which is lying in the case dairy itself. In these circumstances, CJM ordered that SHO P/S Khour and Naib-Tehsildar Executive Magistrate Ist Class Akhnoor shall appear in person before this Court tomorrow at 10:00 AM and explain their position. Court further directed police to produce the accused in the Court tomorrow.
