| HC begins hearing of delimitation petition filed by Panthers | | | Early Times Report Jammu, Mar 12- The Division Bench of High Court of Jammu and Kashmir comprising Chief Justice Biren Ghosh and Mansoor Ahmed Mir today started hearing in the Delimitation case. The High Court has started hearing a writ petition filed by Panthers Party seeking direction of the High Court to the Government of Jammu and Kashmir to constitute Delimitation Commission within the meaning and scope of Section 47 of the Constitution of J&K to delimit the Assembly Constituency regarding extent and boundaries. Arguing forcibly Prof. Bhim Singh submitted that refusal by the State to appoint a Delimitation Commission amounts to discrimination against the people of Jammu and Kashmir, destroys the basic structure of the Constitution and amounts to a fraud on the Constitution. Prof. Singh submitted that 29th Amendment to the J&K Constitution didn’t place any bar on the constitution of Delimitation Commission. He said that the Delimitation Commission was constituted by the Parliament under Justice Kuldip Singh in spite of the 84th Amendment to the Constitution which has banned the increase in the Lok Sabha constituencies. Prof. Singh argued the case for nearly two hours in a jam-packed court of the Chief Justice. H.C. Jalmeria, B.B. Kotwal and Bansi Lal Sharma, Advocates assisted Prof. Bhim Singh. The Advocate General of Jammu and Kashmir wanted adjournment which was not allowed by the court. The case shall continue tomorrow.
