Jammu, July 1: Special Judge CBI Bala Jyoti today extended remand of four days of the alleged kingpin of the 2022 JKSSB sub-inspector recruitment exam paper leak to Enforcement Directorate custody. It is worthwhile to mention here that today CBI Court extended the remand in new laws.
Today ED filed application for extension of custody remand for 07 days U/S 187 of Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Code of Criminal Procedure, 1973) r/w section 65 of PMLA, 2002 (Through video conference mode).
Accused Yatin Yadav (aged 43 years) S/O Sh. Deshraj Yadav R/o B/86 B, Vikas Nagar, Gali No.5, Rewari Haryana has been produced before me through virtual mode today on 01.07.2024 by I.O Sh. Rahul Verma, Deputy Director, Enforcement Directorate, Sub Zonal Office, Jammu. I.O has prayed for remand of accused for a period of 07 days.
Special Judge CBI Jammu Bala Joyti after hearing Special PP Ashwani Khajuria for the ED and after perusal of the application filed herein today on 01.07.2024 and CD File, transpires that accused was arrested u/s 19 PMLA on 24.06.2024 at 6.30 PM in case FIR No. RC0042022A0008 dated 03.08.2022 registered by CBI Jammu u/s. 120-B, 420 IPC, 1860 and grounds of arrest have again been furnished to the accused person after his arrest in light
The ED filed an application for extension of custody remand for 7 days U/S 187 of BNSS.
The Special Judge after hearing the special PP for the ED observed that the accused be kept in custody.
The court apprised the accused of his right to engage counsel and access to medical aid.
The court directed that the accused shall be produced in the Court by the I.O after expiry of the remand period through virtual mode only.

CD file reveals that on the basis of aforesaid FIR, investigation under the provisions of Money Laundering Act 2002 (PMLA) was initiated by this Directorate after recording of an ECIR bearing No. ECIR/MSZO/01/2023 dated 31.03.2023 as per the Medical Certificate, accused appears to be physically fit. Carefully perused case diaries and medical examination of accused person conducted on 01.07.2024 by Dr. Sh. Sunil Bhagat Medical Officer Police Hospital Jammu.
Court heard Investigating Officer Sh. Rahul Verma, Deputy Director E.D as well as Counsel Sh. Asheesh Singh Kotwal appearing for accused person herein (Vakalatnama filed). From perusal of case diaries and entire material on record, it transpires that since accused was arrested on 24.06.2024 and investigation of the case is at initial stage, as such he is remanded to E.D custody for a period of 04 days w.e.f. 01.07.2024. fts he is involved in serious economic offences. He shall be subjected to regular medical examination under rules. Accused is again apprised of his right to engage counsel and access to medical aid. Accused shall be produced in the Court by the I.O after expiry of the remand period through virtual mode only. I.O is also directed to expedite the investigation within remand period. JNF
