Jammu, Mar17- Justice Nissar Ahmed Kakru of Jammu and Kashmir High Court today issued notice to Elections Commission and others in an election petition filed by Chander Parkash BJP candidate from Vijaypur constituency challenging the election of Surjeet Singh Salathia NC candidate elected (presently Minister). After hearing Advocate L K Sharma appearing for the petitioner, the Court also served notice to Chief Electoral Officer of J&K State, District Election Officer (DC Samba), Returning Officer Vijaypur (ACD RDD Samba), Assistant Returning Officer Vijaypur (BDO Samba), Surjeet Singh Salathia and other 17 candidates. The petitioner in his petition challenged the victory of the NC candidate on several counts and submitted that the respondent was beneficiary of not less than 4000 invalid votes which were allowed to be cast in the said election by the serious acts on the part of the officials respondents. It was further alleged that the invalidity of the said votes stems from the act that all the said votes were either shifted votes, dead votes, double votes which were in no situation entitled to enjoy the voting right. Total number of invalid votes in all the 123 polling stations of the Vijaypur constituency runs up to not less than 4000 which has singularly impacted to tilt the result of the election in favour of the NC candidate by the margin of 1212 votes. In the petition it has been prayed to declare the election of NC candidate as illegal and void and order for recounting of the votes and declaring the petitioner elected from the Vijaypur constituency.
