| HC holds petitioner entitled for disability pension | | | Early Times Report Jammu, Mar18- In a petition filed by the petitioner who was boarded out from army service in the year 1998 on medical grounds seeking disability pension, Justice JP Singh of J&K High Court Jammu Wing, after hearing Advocate Surinder Kour appearing for the petitioner Joginder Singh and Advocate PS Chandel appearing for the Union of India, today directed Union of India to consider grant of Disability Pension and other consequential benefits to the petitioner under rules with in a period of six weeks. Justice Singh while directing the Union of India, observed that in view of the law laid down by the Division Bench of State High Court, the petitioner is held entitled to the disability pension and allowed the petition and quashed the Chief Controller of Defence Account’s order dated August 23, 1999 and directed the respondents to consider grant of disability pension and other consequential benefits to the petitioner under rules within a period of six weeks. According to the petition, the petitioner was enrolled in the army on January 6, 1983. He was invalided out from service on April 10, 1998 due to the invaliding disease. Advocate Surinder Kour appearing for the petitioner submitted that petitioner has been promoted as l/Naik, by the army authorities and at the time of petitioner’s initial entry into army service he was not found suffering from any such disease for which he would be invalided out. It was further submitted that petitioner had suffered from Psychosis due to stress and strain of the service which was attributable and aggravated by the military service and was as such entitled to the grant of disability pension.
