HC stays order of DC Poonch revoking PSP certificate of civil judge

JAMMU, July 19: Justice Rajesh Sekhri of Jammu & Kashmir and Ladakh High Court stayed the order of Deputy Commissioner Poonch whereby Deputy Commissioner Poonch revoked the PSP certificate of newly selected Munsiff Abrar Nawaz Qureshi.
Justice Rajesh Sekhri stayed the order after hearing Sr. Adv Vikram Sharma for the petitioner whereas Sr, AAG Monika Kohli for the UT and Sr. Adv Pranav Kohli for the private respondent.
During the course of hearing Sr. Adv Vikram Sharma submitted that petitioner is actually resident of Village Chajjla, Tehsil Mankote, Distt. Poonch and this village is adjoining the Line of Actual Control and has already been declared as such and while actually & physically residing 16 in the Village, petitioner completed his School education i.e. upto 8th Standard from Public Education Trust and Public Higher Sec. School, Mendhar, Poonch and thereafter has passed 10th, 11th and 12th classes from Govt. Higher Sec. School, Mankote. Photocopies of the certificates issued by Tehsildar Mendhar and Mankote to the extent that these schools falls in the villages categorized as adjoining Line of Actual Control and after passing 12th Standard Exam, petitioner was very keen to study Law, as such, applied for undergoing five-year Law Course and accordingly got selected for undergoing the Course at Law School, University of Jammu, and, successfully passed the same in 2019 and thereafter got himself enrolled as an Advocate and started practicing law in different Courts w.e.f. March, 2020. The Govt. of J&K through Social Welfare Department issued Notification on 20.04.2020 in form of S.O. 127, in terms of which, certain amendments were made in the J&K Reservation Rules, 2005, thereby giving 4% reservation in Direct Recruitment to Pahari Speaking People (PSP). Since the petitioner belongs to Pahari Community, more particularly a tribe having a distinct cultural, ethnic and linguistic identity, as such, on being duly identified by the competent authority, petitioner after joining the legal profession and also becoming independent as well as having the schoolings from Schools located in the Villages adjoining the Line of Actual Control, applied to respondent No.2 (Competent Authority)for issuance of Pahari Speaking People (PSP) Category Certificate.
Justice Rajesh Sekhri after hearing Sr. Adv Vikram Sharma issued notice to the respondents and stayed the order of Deputy Commissioner Poonch. —JNF
