Extend ITR filing date: Tax BAR Association urges Finance Minister

Jammu, July 26: Tax BAR Association, Jammu, an Apex body of association representing tax lawyers, has appealed to the Union Finance Minister Nirmala Sitharaman to extend the income tax return filing date till August 31, 2024.
In a letter addressed to the Union Finance Minister, the association has stated: “ We respectfully submit that the Tax BAR Association, Jammu is an Apex body of association representing tax lawyers. The association has been established for more than 60 years. The TBA Jammu was established with an aim to represent issues of Tax Lawyers and increase awareness in tax payers. The Tax Bar Association is one of the oldest and active bar associations in India. It is regularly organizing conferences, study circle meetings and other tax related activities for the benefit of its members. The prime object of the association is not only to work for the cause of the fellow professionals but also to educate the public at large. We act as a catalyst between citizen and the government.”
“The association on discussion with the trade communities and unanimously advised by all the members to make this representation to request for extension of income tax return filing date from 31.07.2024 to 31.08.2024,” the letter states, adding, “There are many technical glitches in the Income Tax Portal since June, 2024 and the relevant information viz. form 26AS, AIS, TIS information and other critical documents could not be downloaded. In fact for the last 20 days, there are problems even at the time of login as the site remains busy. There are new assesses who are required to be registered on the income tax portal and there are also difficulties in registering the new assessee due to overburdening of the Income Tax Portal, which was not the case in earlier years.”
“It is also brought to your kind attention that while e-verifying the returns, the One Time Passwords could not also be generated due to which there is delay in filing the same and hence much difficulty in filing returns. It is further submitted that in some cases the taxes have been deposited through UPI, but the same are not credited under the PAN of the assessee inspite of the amount being debited from the bank account, this has also resulted in non-filing of ITR. These technical disruptions have created immense challenges for tax payers as well as professionals particularly as the deadline for filing Income Tax Returns in non-auditable cases approaches,” the letter states.
“The Income Tax Portal’s response to queries suggests that the increased rebate limit from Rs. 12500.00 to Rs. 25000.00 applies uniformly to both the regimes, However, the application of this rebate to specific income types under the new regime remains unclear, adding to the taxpayer’s concerns. The introduction of higher turnover limits under section 44AD and section 44AB, along with other provisions such as TDS, GST, and the new reporting requirement under section 43B(h) for payments to MSMEs, has increased the complexity and time needed to prepare and file returns. The quick processing of ITRS by the CPC and the detection of discrepancies between AIS/TIS and 26AS further complicates the filing process, often leading to errors and rectification notices,” the letter adds.
“It is submitted that the deadline for filing Income Tax Returns in non auditable cases and salary returns approaches. It is noteworthy that the deadline coincides with the due date for filing TDS returns on 31st July,and also aligns with the last date for filing GSTR-3B under the GST regime and the last dates for filing of appeals under the GST regime. In light of these circumstances, we humbly request your intervention to consider our problem and accordingly direct the concerned authorities to resolve the problem immediately so that the professional and taxpayers may file their returns as early as possible and further to extend the last date for filing of Income Tax Returns in non-auditable cases and salary returns,” the letter adds.
